The goods

Ordering and contract

The contract offer becomes binding upon completion of checkout. The company sends an electronic acknowledgment of receipt; the contract is concluded upon physical delivery of the parcel to the courier. The company reserves the right to decline the order in case of stock exhaustion or unreliable contact details, arranging for the immediate refund of received payments.

Prices and payment

Prices are stated in EUR and include VAT where applicable. Shipping charges are detailed on the summary screen before payment. Accepted payment methods: Cash on delivery, Bank transfer. Should an obvious pricing error appear on the displayed price prior to parcel dispatch, we reserve the right to correct the amount, giving the customer the option to confirm or cancel the order.

Product images and colours

Images display the actual packaged botanical preparations. Colors seen on screen vary depending on display calibration, browser software, and ambient lighting; a slight chromatic variation of the macerate or syrup does not constitute a lack of conformity, nor does it justify refunds or returns at the seller's expense. Volume, ingredients, and botanical properties are indicated on each product data sheet.

Transfer of risk

Responsibility for the bottles remains with us until physical delivery by the carrier to you or your designated agent at the address provided. From that point on, the risk of damage or loss passes to the recipient. Visible damage to the packaging caused by transit must be reported immediately to the carrier and notified to our customer support within 48 hours.

Returns and warranty

The right to return batches may be exercised within 30 days of delivery, under the terms described in the Returns section. Pursuant to the Italian Consumer Code (Legislative Decree 206/2005), sold products carry a twenty-four-month legal guarantee of conformity for non-conformities existing at the time of delivery, applicable within the limits of the shelf-life date indicated on the intact packaging of the food or botanical product.

Supply of custom-made or clearly personalized goods upon customer request.
Perishable goods that risk deteriorating or expiring rapidly once opened.
Sealed syrup bottles or walnut macerate jars opened after delivery, excluded from returns for hygiene and health protection reasons.
Goods that, after delivery, are by their nature inseparably mixed with other items.
Digital content or informational guides provided on tangible media opened by the consumer after delivery.

Liability

Except in cases of intentional misconduct or gross negligence under Italian law, the total liability of Xolod Botanica S.r.l. toward the buyer shall not exceed the total amount actually paid for the contested order or the agreed value of 100 euros. Nothing contained in these contractual terms limits or excludes liability that cannot be legally limited or excluded under applicable law.

Age and use

Placing an order requires being at least 18 years old. Balsamic compounds must be taken according to the instructions on the label and do not under any circumstances serve as an alternative to medical prescriptions or medical advice.

Governing law and disputes

These Terms are governed exclusively by Italian law. For any civil dispute arising from this contract with a consumer residing in Italy, mandatory territorial jurisdiction belongs to the court of the consumer's place of residence or domicile. If a dispute cannot be resolved through direct communication, the competent court is located at the seller's registered office, without prejudice to mandatory statutory rights granted to the consumer by their country of residence.
